Contra Loma Boat Launch

OVERVIEW East Bay Regional Park District (EBRPD) operates and maintains, under a management agreement with the Bureau of Reclamation, approximately 90 acres of developed parkland and wildlife habitat at Contra Loma Reservoir.

This site offers recreational boating, hiking, picnicking, and fishing.

Visitation,

predominately from Central California counties, averages 150,000 guests annually.

This grant will fund activities which will assist the Recipient to meet its obligation to improve facilities within the Contra Loma recreation area.

As a benefit to the public, this project will:
• Improve parking facilities and roadway conditions at the reservoir site.

• Upgrade current parking areas and provide an adequate base for vehicle traffic use.

Ongoing Federal investment in Contra Loma Regional Park will help the East Bay Park District maintain the popular recreational facility and increase the public recreational use of the site.

RECIPIENT INVOLVEMENT The East Bay Regional Park District will be responsible for the implementation of the project.

Responsibilities include:
1. ) Administration and financial management for the project 2. ) Construction management, project completion and acceptance.

3. ) EBRPD will be responsible for maintenance and operation of the facilities once completed.

4. ) Submit final report.

RECLAMATION INVOLVEMENT No substantial involvement on the part of Reclamation is anticipated for the successful completion of the objectives to be funded by this award.

It is anticipated that Reclamation’s involvement will consist of standard federal stewardship responsibilities such as monitoring project performance, technical assistance at the request of the recipient, etc.

SINGLE-SOURCE JUSTIFICATION DEPARTMENT OF THE INTERIOR SINGLE SOURCE POLICY REQUIREMENTS Department of the Interior Policy (505 DM 2) requires a written justification which explains why competition is not practicable for each single-source award.

The justification must address one or more of the following criteria as well as discussion of the program legislative history, unique capabilities of the proposed recipient, and cost-sharing contribution offered by the proposed recipient, as applicable.

In order for an assistance award to be made without competition, the award must satisfy one or more of the following criteria:
(1) Unsolicited Proposal – The proposed award is the result of an unsolicited assistance application which represents a unique or innovative idea, method, or approach which is not the subject of a current or planned contract or assistance award, but which is deemed advantageous to the program objectives; (2) Continuation – The activity to be funded is necessary to the satisfactory completion of, or is a continuation of an activity presently being funded, and for which competition would have a significant adverse effect on the continuity or completion of the activity; (3) Legislative intent – The language in the applicable authorizing legislation or legislative history clearly indicates Congress’ intent to restrict the award to a particular recipient of purpose; (4) Unique Qualifications – The applicant is uniquely qualified to perform the activity based upon a variety of demonstrable factors such as location, property ownership, voluntary support capacity, cost-sharing ability if applicable, technical expertise, or other such unique qualifications; (5) Emergencies – Program/award where there is insufficient time available (due to a compelling and unusual urgency, or substantial danger to health or safety) for adequate competitive procedures to be followed.

Reclamation did not solicit full and open competition for this award based the following criteria:
(2) CONTINUATION Single Source Justification Description:
Based on the Statutory Authority referenced below, funds available require the recipient to execute an agreement with Reclamation for the administration of the land and water areas for recreation enhancement.

East Bay Regional Parks District (EBRPD) is a Non-Federal, Public Managing Partner and is the only entity which has executed an agreement with Reclamation for the administration of these lands and water areas for recreation.

This award is a continuation of R13AP20012 which, expired December 31, 201 4. The task proposed in this agreement is to improve recreation parking facilities within the Park.

These funds will be utilized to install asphalt.

This is an additional surface applied on top of base material funded in 201 4. STATUTORY AUTHORITY Public Law 89-72 Federal Water Project Recreation Act, Sec 7(a)(b) Stat.

213(1)(2)(3).

AN ACT to provide uniform policies with respect to recreation and fish and wildlife benefits and costs of Federal multiple-purpose water resource projects, and other purposes.

SEC.

7. (a) The Secretary is authorized, in conjunction with any reservoir heretofore constructed by him pursuant to the Federal reclamation laws or any reservoir which is otherwise under his con¬trol, except reservoirs within national wildlife refuges, to inves¬tigate, plan, construct, operate and maintain, or otherwise provide for public outdoor recreation and fish and wildlife enhancement fa¬cilities, to acquire or otherwise make available such adjacent lands or interests therein as are necessary for public outdoor recreation or fish and wildlife use, and to provide for public use and enjoy¬ment of project lands, facilities, and water areas in a manner coordinated with the other project purposes.

Lands, facilities and project modifications for the purposes of this subsection may be provided only after an agreement in accordance with subsection (b) or (c) of section 3 of this Act has been executed.

SEC.

7. (b) The Secretary of the Interior is authorized to enter into agreements with Federal agencies or State or local public bodies for the administration of project land and water areas and the oper¬ation, maintenance, and replacement of facilities and to transfer project lands or facilities to Federal agencies or State or local pub¬lic bodies by lease agreement or exchange upon such terms and conditions as will best promote the development and operation of such lands or facilities in the public interest for recreation and fish and wildlife enhancement purposes.

This statute, as amended, declares the intent of Congress that recreation and fish and wildlife enhancement be given full consideration as purposes of Federal water development projects if non-Federal public bodies agree to:
(1) Bear not less than one-half the separable costs allocated for recreational purposes or twenty-five percent of the cost for fish and wildlife enhancement; (2) Administer project land and water areas devoted to these purposes; and (3) Bear all costs of operation, maintenance and replacement.
